3.1 Eligibility

To use the Services, you must be at least eighteen (18) years old or have reached the age of majority in your jurisdiction. By using the Services, you represent and warrant that you meet this eligibility requirement.

3.2 Account and registration

No account is necessary to utilize the general features of our Services, but to store relevant information for future use of and personalise your use of our Services, you must register an eComID profile.

When you are logged in on a merchant's Website, we may utilize the information you have provided to the merchant, such as your email address and other relevant details. It is your responsibility to ensure that the information registered with merchants is accurate, current, and complete.

3.3 Specific terms regarding your use of eComID Agent

eComID Agent is designed to support you in making informed shopping decisions. eComID Agent utilizes artificial intelligence and machine learning technology to provide personalized shopping assistance.

Artificial intelligence and machine learning are rapidly evolving technologies. eComID continuously works to improve eComID Agent, making it more accurate, reliable, safe and beneficial. However, given the probabilistic nature of machine learning, eComID Agent's output may occasionally be incomplete, inaccurate, or not fully tailored to every specific need. You are responsible for verifying all recommendations before making purchase decisions. eComID Agent must not be relied upon for legally, medically, or financially significant advice, or for urgent or critical decisions. eComID Agent provides suggestions only, based in part on product data provided by merchants. While we strive for accuracy, we cannot guarantee results. This does not affect your statutory rights.

5.1 Compliance with laws

You agree to use the Services in compliance with all applicable laws and regulations.

5.2 Prohibited activities

You agree not to (i) use the Services for any illegal or unauthorized purpose; (ii) interfere with or disrupt the Services/Websites or servers or networks connected to the Services/Websites; or (iii) attempt to gain unauthorized access to any part of the Services or Websites.

7.1 Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted or error-free.

7.2 Limitation of liability

To the fullest extent permitted by law, subject to your statutory rights which cannot be excluded, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Services or (ii) any unauthorized access to or use of our servers and/or any personal information stored therein.

10.1 Governing law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles.

10.2 Dispute resolution

Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall be resolved by the courts of Sweden, unless otherwise required by mandatory consumer laws in your country of residence, according to which you, e.g., may choose to bring legal proceedings in your country of residence, or we are required to only bring legal proceedings in your country of residence.

11.1 Duration

These Terms apply as long as you use the Services and, where applicable, until termination in accordance with Sections 11.2 or 11.3 below.

11.2 Suspension and termination by eComID

We reserve the right to suspend or restrict your access to all or any part of the Services (including, if you have registered an eComID profile, deleting your profile) at any time, with or without cause, with or without notice, effective immediately. This includes situations where you violate these Terms or engage in conduct that we determine to be harmful to the Services or other users. We also reserve the right to terminate or modify any part of the Services at any time.

11.3 Termination by you

You may stop using the Services at any time, and if you have registered an eComID profile, you may delete it at any time.

11.4 Effect of termination or suspension

Upon termination or cessation of your use of the Services (whether by you or by us), your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, data collection and privacy, warranty disclaimers, indemnity, and limitations of liability.

12.1 Entire agreement

These Terms constitute the entire agreement between you and eComID regarding the use of the Services and supersede any prior agreements between you and eComID relating to your use of the Services.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.

12.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and eComID's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
